For VAT, the decision changes more than logistics. If your own goods sit in a warehouse in another EU country, you normally need a VAT registration in that country before the first unit arrives, whatever your sales.

This guide is for the moment before you sign with a 3PL: when it triggers a registration, when it does not, and what to arrange first. For what happens once the stock is moving, see our guides to VAT on stock movements and thresholds and multi-country storage.

The short answer

Your own goods in a 3PL warehouse in another EU country mean a VAT registration in that country, from the first unit. There is no threshold.

Sending goods from your country to the 3PL is a transfer of your own goods. It is declared in the country they leave and in the country they arrive in.

Sales to customers in the 3PL’s country go in that country’s local VAT return. Sales to consumers in other EU countries can go through OSS.

As soon as your goods ship from more than one country, the €10,000 threshold no longer applies.

The obligations are yours, not the 3PL’s.

Why storage creates a VAT registration

When your goods sit in another EU country and you sell them to customers there, those are domestic sales in that country. You charge its VAT and declare it in its VAT return, which needs a local registration.

Before any sale happens, moving your own goods across a border is already a taxable event: a deemed intra-Community supply where the goods leave and a deemed intra-Community acquisition where they arrive. To declare the arrival you need a VAT number in that country. That is why the registration has to be in place before the first shipment, not after the first sale.

Four common 3PL setups

Setup

What it means for VAT

3PL in your own country

No new registration. Cross-border sales to consumers go through OSS once you exceed €10,000 across the EU.

3PL in another EU country

VAT registration there before the first shipment. The transfer is declared in both countries. Local sales go in the local return, sales to other EU countries can go through OSS.

Several 3PLs in different countries

A registration in each country where your goods are stored, and a transfer declared every time stock moves between them.

Non-EU seller importing straight into an EU 3PL

Import VAT in the country of import, and a VAT registration there to recover it and to sell from the stock. Some countries also require a fiscal representative.

For the last case, see fiscal representation in the EU.

Call-off stock does not cover a fulfilment warehouse

The EU call-off stock simplification lets a seller send goods to another country without registering there, but only for goods sent to a known business customer who takes them within twelve months. A 3PL that holds your stock and ships it to consumers does not qualify. Amazon’s own use of the scheme has ended as well.

Checklist before you sign with a 3PL

Register for VAT in the 3PL’s country before the first shipment, and use that VAT number for the transfer.

Ask the 3PL for stock reports per movement: goods in, goods out, customer returns and write-offs. You will need them to reconcile your returns.

Record every transfer of your own goods, in both countries.

Check the Intrastat thresholds in both countries.

Plan how customer returns come back: to the 3PL or to you. A return to another country is another movement.

If you are a non-EU business, check whether the country requires a fiscal representative.

Decide which sales go through OSS and which through the local return.

How hellotax helps

We register your business for VAT in the main EU markets and the UK and file the returns, transfers included, with our own software and local tax advisors. There is no minimum storage period: your own goods held for sale in that country create the obligation.

Can OSS replace the registration in the 3PL’s country?

No. OSS covers distance sales to consumers in other countries. It does not cover sales to customers in the country where the stock is, or transfers of your own goods.

Does the 3PL handle the VAT for me?

No. The goods are yours, so the registration, the returns and the transfer reporting are your responsibility.

What if the 3PL is in my own country?

Then storage does not create a new registration. Your cross-border sales to consumers follow the normal rules: your home VAT below €10,000 across the EU, destination VAT through OSS above it.

Storing your goods with a fulfilment partner in another EU country means a VAT registration there, before the first unit arrives.
